Recently, the patent application filed in the US and petty patent application filed in Laos, represented by Beijing Tiandun Intellectual Property Agency(Tiandun IP),have successfully passed the substantive examinations and the patent certificates have been issued.
Considering the applicant wanted to get the US patent as soon as possible,the applicant has filed a PCT international phase application,and the priority application,namely,the Chinese patent has been granted,whose priority is still within 12 months.Tiandun IP carefully analyzed the case based upon the above,and recommended filing the US national patent claiming a China priority instead of entering the US national phase,and submitting the PPH (patent prosecution highway) request when filing to expedite the examination.It just took bout three months for the United States Patent & Trademark Office (USPTO) to issue the first Office Action (OA) after the patent application filed,but for an ordinary patent application,usually,it would take about two or even three years.The Notice of Allowance and Fee(s) Due was issued about one month after responding the OA (ROA). For this application,it only took about 4 months from filing to allowance.The case fully demonstrates the PPH’s three advantages,namely,expediting the examination,increasing the chance of allowance,and saving the costs.
Laos, member of the Association of Southeast Asian Nations, with the official operation of the China-Laos railway,more and more Chinese applicants are considering extending patent protection to the country. As the country's patent system is less developed, the following points should be noted when entering Laos:
1. If the applicant is not the inventor, the assignment shall be filed, and the assignment agreement shall be notarized, the original is required;
2. The power of attorney shall be notarized, the original is required;
3. The certified copy of priority document shall be original;
4. The specification shall be translated into Laotian, if it is not translated by a local translation company, it shall be notarized.
